Welcome to Linda Barakat Fine Arts. By accessing this website and purchasing our artwork, collections, or commissioning custom projects, you agree to comply with and be bound by the following Terms and Conditions. These terms apply legally to all visitors, buyers, and corporate collaborators.
Intellectual Property & Art Copyrights
All content displayed on this website–including original oil and acrylic paintings, mixed media, multi-panel canvas installations, sculptural ceramic objects, descriptions, text, and high resolution images–is the exclusive intellectual property of Linda Barakat Fine Arts LLC. The purchase of a physical artwork or hand-embellished print does NOT transfer copyrights to the buyer. You may not replicate, print, distribute, or commercially exploit any artwork images without express, written consent from the artist.
Custom Commissions & Collaborations Agreement
By approving a project proposal and submitting a deposit, the client agrees to the following studio terms and conditions:
1. Financial Terms & Deposits
Small Custom Orders: Made-to-order functional ceramics and custom original artwork valued under $250 require 100% upfront payment before studio production begins. For all custom ceramic editions, triptychs, mixed media works, paintings, or large scale spatial installations, the client agrees to the following structural production roadmap:
Retainer Payment: A 50% non-refundable retainer is required to secure your project on the studio calendar. Physical work, material sourcing, and detailed sketching will not begin until this payment is cleared.
Final Balance: The remaining 50% balance is due immediately upon visual approval of the completed artwork, prior to shipping, delivery, or installation setup.
2. Design Process & Revisions
- Approval Phase: The project scope and color palette will be mutually agreed upon via initial sketches or material samples before production.
- Included Revisions: The total project cost includes one round of minor adjustments during the creation phase (prior to final kiln-firing or canvas-sealing).
- Scope Changes: Substantial changes requested after production has begun (such as modifying the approved dimensions, core concept, or structural layout) will incur an additional design alteration fee determined at the artist’s discretion based on the required studio time and materials.
3. Production Timeline
- Estimated timelines are projections based on the current studio calendar, drying rates, and curing phases.
- While the studio makes every effort to meet estimated completion windows, the client will be promptly notified of any unexpected adjustments due to physical material behavior or shipping carrier delays.
4. Shipping, Delivery, and Logistics
- All shipping, custom handling, packaging crates, and transit insurance costs are calculated separately and are the sole financial responsibility of the client.
- All orders—whether packed by hand inside the artist studio or fulfilled directly through select archival printing partners—are prepared to professional fine art standards. Linda Barakat Fine Arts LLC is not legally responsible for postal carrier delays or damages incurred during transit. All damage claims must be filed directly through the transit insurance provider.
5. Copyright & Ownership Rights
- Intellectual Property: Linda Barakat Fine Arts LLC retains full, exclusive copyright and reproduction rights to the artwork. The client owns the physical piece of art but may not reproduce, copy, or use the imagery for commercial financial gain without a signed commercial licensing agreement.
- Studio Self-Promotion: The studio reserves the right to document, photograph, and share the creation process and final piece across digital portfolios, social media platforms, or print marketing.
6. Cancellation & Abandonment Policy
- If the client cancels the project at any stage after production begins, the 50% deposit is forfeited to compensate the studio for dedicated labor, materials, and lost scheduling opportunities.
- If a completed commission remains unpaid, uncollected, or without communication for more than 30 calendar days after the final notification of completion, the project will be deemed abandoned. The deposit will be forfeited, and the studio retains full physical ownership and resale rights of the artwork.
Governing Law
These terms, agreements, and all store transactions are legally governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles. Any legal disputes shall be handled exclusively within the local jurisdiction courts of Michigan.
